SMS messaging terms & compliance

1. Program description: This messaging program sends booking confirmation, pickup reminder, return reminder, and rental support messages to customers who have booked gear rental through our website at https://redcraterentals.com, or who have explicitly opted in to receive SMS notifications. Marketing SMS opt-in is collected only through the LeadConnector chat widget on our website, where users enter their name and phone number and optionally check a consent box. Transactional rental texts (confirmations and reminders) are sent to customers who provide a phone number at checkout. Messages include booking confirmations, pickup and return reminders, rescheduling updates, and customer support communications related to rentals.
2. Cancellation instructions:You can cancel the SMS service at any time. Text “STOP” to the same number that sent you messages. We will confirm your unsubscribe status via SMS. Following confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially.
3. Support information:Reply “HELP” for assistance, or contact us at info@redcraterentals.com or (561) 475-1441 during business hours (Monday through Friday, 9:00 AM to 6:00 PM Eastern; Saturday, 10:00 AM to 4:00 PM Eastern; Sunday by appointment).
4. Carrier liability: Carriers are not liable for delayed or undelivered messages.
5. Message & data rates: Message and data rates may apply. Message frequency varies based on your rental activity and service usage. Contact your wireless provider with questions about your text or data plan.
6. Supported carriers:Our SMS program works with major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, and most regional carriers.
7. Age restriction: You must be 18 years or older to participate in our SMS program.

We comply with applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines, regarding SMS communications.

General terms

This website (the “Site”) is owned and operated by Red Crate Rentals LLC(“COMPANY,” “we,” or “us”). By using the Site, you agree to be bound by these Terms of Service and to use the Site in accordance with these Terms of Service, our Privacy Policy, and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from Red Crate Rentals LLC.

Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service. We reserve the right to change these Terms of Service or to impose new conditions on the use of the Site from time to time, in which case we will post the revised Terms of Service on this website. By continuing to use the Site after we post any such changes, you accept the Terms of Service, as modified.

The Site is provided solely for your personal non-commercial use. You may not use the Site or the materials available on the Site in a manner that constitutes an infringement of our rights or that has not been authorized by us. Unless explicitly authorized, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium any material from the Site. You may download and/or print one copy of individual pages for your personal, non-commercial use, provided that you keep intact all copyright and other proprietary notices.

Your license to us

By posting or submitting any material (including comments, photos, and videos) to us via the Site, internet groups, or other digital venues, you represent that you own the material or have obtained the necessary permissions. You grant us a royalty-free, perpetual, irrevocable, non-exclusive, worldwide license to use, modify, transmit, sell, exploit, create derivative works from, distribute, and publicly perform or display such material.

Online commerce

Certain sections of the Site allow you to purchase gear rental services. Prices are calculated server-side; payment is processed by Stripe. We are responsible for fulfillment of rentals booked through https://redcraterentals.com. If you make a purchase, the information obtained during your visit, including payment information, may be collected by us and our payment processors.

Registration & passwords

To access certain features of the Site, you may be required to register and create an account (via Clerk). You agree to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. If you suspect unauthorized use of your account, notify us immediately at info@redcraterentals.com. We are not liable for any loss or damage arising from your failure to comply with this obligation.

Termination

We reserve the right to terminate or suspend your access to the Site, without notice, if we determine that you have violated these Terms of Service or engaged in conduct that we deem inappropriate or unlawful. Upon termination, you must cease all use of the Site and any content obtained from it.

Governing law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida. Any dispute arising under these Terms shall be resolved exclusively through binding arbitration in Palm Beach County, Florida.

Changes to terms of service

We may update these Terms of Service from time to time. The latest version will always be available on our website with the effective date (Jan 1, 2026).

Rental agreement

Red Crate Rentals — Rental Agreement (v1.2)

Red Crate Rentals LLC ("RCR," "we," "us") rents camera, lighting, grip, and related production equipment ("Gear") to you ("Renter," "you"). By signing, you agree to the following terms for your rental.

1. Rental Period & Return

Gear is rented for the dates and pickup/return windows shown on your order, all in Eastern Time. Late returns past the grace period are billed at the daily rental rate per item per day. There are no refunds for early returns.

2. Care & Responsibility

You are responsible for the Gear from pickup until it is returned and inspected. You will use it safely and as intended, and keep it within the United States unless we agree otherwise in writing.

3. Insurance / Damage Options

You choose ONE of the following at checkout. This choice changes your liability.

(a) Damage Waiver

If you purchase the optional damage waiver (a percentage of your rental subtotal), your liability for accidental damage to a covered item is capped at ten percent (10%) of that item's replacement value. The waiver does NOT cover theft, loss, water/liquid/sand damage, intentional misuse, gross negligence, or damage occurring outside the United States. You remain fully liable for those.

(b) Self-Insurance & Charge Authorization (waiver declined)

If you decline the damage waiver, you are SELF-INSURED. You accept full financial responsibility for the repair or full replacement value of any Gear that is damaged, lost, or stolen while in your care, with no cap. You expressly AUTHORIZE RCR to charge the payment method on file, on or off session, for those repair or replacement costs, plus any applicable late fees, without further authorization.

(c) Certificate of Insurance (COI)

You may instead upload a certificate of insurance naming Red Crate Rentals LLC as certificate holder and loss payee, with coverage adequate for the Gear's replacement value (recommended for rentals over $10,000). Approval is at our discretion.

4. Payment & Saved Card Authorization

You authorize RCR to charge your payment method for the order total and to securely store it with our payment processor for future charges permitted by this agreement, including late fees and, if you are self-insured, damage or replacement costs. We never store full card numbers ourselves.

5. Cancellations & Refunds

Refunds follow our posted schedule: 100% if cancelled 72+ hours before pickup, 50% if 24-72 hours before, and 0% if under 24 hours. No refunds for early returns.

6. Assumption of Risk & Liability

You assume all risk arising from your use of the Gear. To the fullest extent permitted by law, RCR is not liable for any indirect, incidental, or consequential damages, and our total liability will not exceed the amount you paid for the rental.

7. Governing Law

This agreement is governed by the laws of the State of Florida, and venue lies in Palm Beach County, Florida.
